The Ministry of Health has confirmed updates to British Columbia’s Mental Health Act forms, aimed at strengthening patient rights and supporting the recently launched Independent Rights Advice Service (IRAS). These changes will take effect December 3, 2025, following the formal enactment of legislation that was recently accepted to embed IRAS into provincial law.
Key Changes Effective December 3
- New Form 22 – Formalization of the current booking Form for IRAS meetings.
- Updated Forms – Notifications and procedural forms now include explicit reference to the right to meet with a Rights Advisor:
- Form 13.1 – Notification to Involuntary Patient of Rights
- Form 14.1 – Notification to Patient Under Age 16 admitted at the request of a parent or guardian.
- Form 16.1 & 16.2 – Notices to near relatives related to changes in patient status.
- Form 7 – Application for a Review Panel Hearing, updated to reflect the right to request independent rights advice
Alongside these form updates, the Ministry will release a new edition of The Guide to the Mental Health Act and updated Provincial Standards for Designated Mental Health Facilities, which emphasize cultural safety, accountability, and patient rights.
